Environmental Assessment Programs

The numerous environmental laws and regulations place significant demands for compliance on business. The firm has substantial experience in establishing and implementing environmental assessment programs designed to aid in the development and evaluation of environmental compliance plans. In addition, our attorneys have conducted due diligence assessments on behalf of financial and business clients in conjunction with an acquisition or divestiture. Such reviews include not only the identification of existing and future environmental issues, but also key recommendations in resolving or mitigating any problems that may arise during an acquisition or divestiture.

Damon & Morey’s relevant experience includes:

  • Negotiating, evaluating, and drafting key provisions and separate agreements in favor of a corporate seller of various assets including industrial production facilities, real property, etc. This transaction involved extensive review of the seller’s environmental risk status and extended follow-up to ensure compliance with the terms identified under the asset transfer provisions.
