Environmental Liabilities : Litigation, Evaluation and Coverage Opinions
The firm has proven experience in interpreting and evaluating all
types of commercial liability insurance policies including those claims
involving environmental liabilities. We have represented insurance
company clients in complex coverage cases and provided coverage opinions
for matters involving comprehensive general liability policies and their
application to Superfund and RCRA clean-up costs and toxic tort and
product liability suits. Our attorneys also frequently develop coverage
opinions relating to environmental liabilities for our insurance
clients.
Our experience includes:
- Providing detailed, comprehensive coverage opinions to our
insurance company clients evaluating coverage for their insureds for
waste generation, disposal, and releases.
- Defending a national insurance company in several environmental
liability coverage cases in New York and New Jersey including waste
management and solvents litigation. These complex cases often involve
more than one hundred co-defendant insurance companies.
- Worked closely and offered assistance to with counsel on
environmental coverage issues pending in Washington and California.
- Provided discrete on-site audits of defense counsel asbestos files
for carrier interested in obtaining effective resolution of matters
without increasing costs; assisted with the organizing files for
better reporting; and acted as a facilitator between the local defense
counsel and the carrier.
