Ms. McEldowney is Special Counsel at Damon & Morey in
the Health Care Practice Group of the
firm’s Business and Corporate Department.
Ms. McEldowney has been active in the corporate and health care legal
community since her admission to the New York State Bar in 1986. Her
prior positions include having served as Deputy Counsel for Independent
Health Association and Vice President and General Counsel of a local
third party administrator, North American Health Plans, Inc.
Ms. McEldowney practices in the areas of health law, corporate law,
information technology, and ERISA/employee health benefits with a focus
on corporate, regulatory and managed care issues, as well as issues
relating to self-funded group health plans. Her work involves
representation of hospitals, skilled nursing facilities, physicians and
other health care providers, insurance brokers, third party
administrators, municipal health plans and not-for-profit organizations.
She counsels clients on matters such as patient care issues, medical
ethics, regulatory compliance, HIPAA privacy and security, information
technology issues, network formation and governance, contracting
(including PPO leasing agreements, administrative services agreements,
vendor agreements, and software license agreements), billing and
reimbursement matters, and claims appeals.
Ms. McEldowney is the Vice President of the Healthcare Executive Forum
of Western New York, an independent, non-profit, professional membership
organization and affiliate of the American College of Healthcare
Executives. She is also a member of the American Health Lawyers
Association, the New York State Bar Association, the Health Law
Committee of the Erie County Bar Association and the Western New York
Chapter of the Women's Bar Association of the State of New York. She
lectures frequently on health issues across the state. Recent topics on
which she has spoken include Provider Contracting, Contractual Rights of
the Patient/Enrollee and HIPAA Compliance.
