Mr. O’Neill is a Partner at Damon & Morey
LLP practicing in the Business Litigation and
Insolvency Department and the Co-Chairman of the
Intellectual Property Practice Group.
He works primarily with corporations and
professional clients in complex litigation involving trademarks,
copyrights, patents, trade secrets, unfair competition, non-competition
and confidentiality agreements, insurance coverage, commercial
transactions, professional service contracts, fraud and other business
torts. He has also represented broker-dealers and customers in NASD
arbitrations, equipment leasing companies in collection matters, and
general and secured creditors, including construction contractors and a
major federal student loan guaranty corporation, in bankruptcy
proceedings.
Mr. O’Neill is admitted to practice in all state trial and appellate
courts in New York and Pennsylvania, as well as the U.S. District Courts
and Bankruptcy Courts for the Western and Northern Districts of New York
and the Western District of Pennsylvania, the U.S. Court of Appeals for
the Second Circuit and the Second Circuit Bankruptcy Appellate Panel.
Mr. O’Neill is a frequent speaker at continuing legal education seminars
and has spoken on intellectual property litigation, information
technologies, construction litigation, and federal civil practice. He is
a former Barrister of the American Inns of Court, and has served as
assigned trial counsel for the local federal court, and as a pro bono
attorney for a municipal Volunteer Legal Service Project. He was also
recently named among Upstate New York's “Super
Lawyers."
A member of the Class of 2005, Mr. O’Neill is a member of Leadership Buffalo's
Board of Directors. He teaches physically and mentally
challenged individuals in the Lounsbury Adaptive Ski Program at the
Holiday Valley Resort in Ellicottville, New York, and the Disabled
Sports USA/Hartford Ski Spectacular in Breckenridge, Colorado. He also
served for several years on the Erie County Bar Association Lawyers for
Learning Project Committee, as a volunteer tutor at Buffalo Public
School 18, and as a member of the Advisory Board of the New York Branch
of the National Center for Missing and Exploited Children. Additionally,
he is a member of the firm's Client Development Committee.
